Terms of Service

1. Agreement

By using the Brutal Noise website (brutalnoise.net / brutalnoise.bg) and services, you agree to these Terms of Service. If you do not agree, please do not use the site. We may update these terms at any time; continued use constitutes acceptance of changes.

2. Account Registration

• You must provide accurate information when creating an account.
• You are responsible for keeping your login credentials secure.
• You must be at least 16 years old to create an account.
• We reserve the right to suspend or terminate accounts that violate these terms or are used fraudulently.

3. Orders & Payments

All prices on the site are listed in euros (EUR) and include applicable taxes unless otherwise stated.

• Bank Transfer — your order is processed after payment is received and confirmed.
• Cash on Delivery — payment is collected upon delivery.
• Card Payment — processed securely through Stripe when available.

We reserve the right to refuse or cancel orders if there is a pricing error, stock issue, or suspected fraud.

4. Custom Products & Design Builders

Our CD, T-Shirt, and Guitar Pick builders let you create custom products. By submitting a custom design:

• You confirm that you own or have the right to use all images, text, and other content in your design.
• You grant us a limited licence to use your design solely for the purpose of producing and fulfilling your order.
• We will not use your custom designs for marketing or any other purpose without your explicit permission.
• We reserve the right to refuse production of designs containing illegal, offensive, or copyrighted content that you do not own.

5. Community Designs

You may share CD designs publicly through our community gallery. By making a design public:

• You allow other users to view your design and its details.
• You retain ownership of your content and can make it private or delete it at any time.
• Designs submitted for community review may be approved or rejected by our team. We may reject designs that contain inappropriate content.

6. Shipping & Delivery

• Custom products (CDs, printed merch) require production time. Estimated timelines are provided at the time of order but are not guaranteed.
• Shipping times vary by destination. We ship to select European countries and the United States.
• Risk of loss passes to you upon delivery. If a package is lost or damaged in transit, contact us and we will work to resolve the issue.

7. Refunds & Cancellations

• Custom products cannot be returned or refunded because they are made to your specifications, unless they arrive damaged or defective.
• Standard products may be returned within 14 days of delivery in unused condition. Contact us to initiate a return.
• Orders may be cancelled before production begins. Once production has started, cancellation is not possible for custom items.
• If a product arrives damaged or defective, contact us within 7 days with photos and we will arrange a replacement or refund.

8. Intellectual Property

All site content, branding, code, and design (excluding user-submitted content) is owned by Brutal Noise and protected by copyright law. You may not copy, reproduce, or redistribute any part of the site without written permission.

9. Prohibited Use

You agree not to:

• Use the site for any unlawful purpose
• Upload malicious content or attempt to compromise site security
• Create accounts with false information
• Submit designs containing content you do not have the right to use
• Resell products purchased through the site without permission

10. Limitation of Liability

Brutal Noise is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the site or our services. Our total liability for any claim is limited to the amount you paid for the specific order in question.

11. Governing Law

These terms are governed by the laws of Bulgaria. Any disputes will be resolved in the competent courts of Vidin, Bulgaria, unless mandatory consumer protection laws in your country provide otherwise.
